1. Acceptance and scope
These Terms govern access to and use of PRIMAL websites and online stores and purchases from Les Entreprises LeSieur inc.. By using the site, creating an account, or placing an order, you agree to these Terms and any policies incorporated by reference, subject to rights that cannot lawfully be waived.
2. Eligibility and accounts
You must provide accurate information and use the site only for lawful purposes. You are responsible for safeguarding account credentials and for activity conducted through your account, except to the extent caused by our own acts or omissions or otherwise provided by law.
3. Product information and availability
We seek to present product descriptions, images, specifications, availability and pricing accurately. Displayed colours and appearance may vary by device. Availability may change. Nothing in these Terms limits mandatory rights relating to goods that do not conform to their description, applicable warranties, or other non-waivable consumer protections.
4. Orders and contract formation
Before submitting an order, you will have an opportunity to review and correct relevant order information. The information displayed at checkout forms part of the transaction, including product, quantity, price, taxes, shipping charges, currency, delivery method and applicable restrictions. After the transaction is concluded, an electronic confirmation may be sent to the contact information provided.
We may decline a proposed transaction before it is concluded where permitted by law, including for suspected fraud, legal restrictions, unsupported destinations, or inability to process payment. After a contract has been concluded, cancellation or modification will be handled only as permitted by applicable law and the policies forming part of the transaction.
5. Prices, taxes and payment
Prices and currencies are displayed on the site or at checkout. Applicable taxes, shipping charges and known fees are disclosed before completion of the order. Payment is processed through authorized payment service providers. We do not require customers to send full payment-card credentials by email or ordinary messaging.
6. Shipping, delivery, returns and refunds
Shipping options, estimated delivery times, return eligibility and refund conditions are described in the Shipping, Returns & Refunds Policy and at checkout. Carrier estimates are not guarantees unless expressly stated. Mandatory statutory rights prevail over any inconsistent policy wording.
7. Contact lenses, prescriptions and safe use
Contact lenses are regulated medical devices in certain jurisdictions, including decorative or plano lenses. Where a prescription is legally required, we will not fulfill an order unless the applicable prescription requirement has been satisfied through an accepted method, including receipt of a valid prescription or legally permitted verification.
For U.S. orders subject to the Contact Lens Rule, prescription information may be submitted to the prescriber for verification. A prescription may be treated as verified only when the legal conditions for passive verification have been met, including the applicable eight-business-hour response period calculated under the Rule. Records may be retained as required by law.
Contact lenses must be used in accordance with professional advice, product instructions and applicable wear, cleaning, hygiene and replacement directions. Do not share lenses. Stop wearing lenses and seek appropriate eye-care advice if you experience pain, redness, unusual discharge, light sensitivity, vision changes or other concerning symptoms. Website information is general information and is not a substitute for examination, diagnosis or treatment by a qualified eye-care professional.
8. Promotions and discount codes
Promotions, discount codes, free-shipping offers and similar benefits may be subject to stated eligibility criteria, dates, minimum purchase values, exclusions and usage limits. Terms displayed with the promotion or at checkout apply to that promotion.
9. Intellectual property
The site and its content, including the PRIMAL name and branding, logos, trademarks, photographs, graphics, text, product presentations, designs, software, and other materials, are owned by or licensed to us and are protected by applicable intellectual-property laws. Except for limited personal use or use necessary to place an order, no content may be reproduced, distributed, modified, republished, transmitted, commercially exploited, or used in a manner that implies authorization or affiliation without permission or another lawful basis. No ownership rights are transferred by use of the site.

11. User-submitted content
Where the site allows reviews, photographs, comments, testimonials, questions, or other user-submitted content, you remain responsible for what you submit and must have the rights and permissions necessary to provide it. You must not submit unlawful, infringing, deceptive, defamatory, abusive, privacy-invasive, or malicious content. To the extent necessary to operate, display, moderate, promote, or improve the service, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, and distribute content you voluntarily submit, subject to applicable privacy law. We may moderate or remove content where reasonably necessary for legal, safety, security, or service-integrity reasons.

By providing electronic contact information, you agree that transactional, account, prescription-verification, service, security, and legal notices may be delivered electronically where permitted by law. Marketing communications remain subject to applicable consent and unsubscribe requirements.

We may update these Terms prospectively. The version applicable to a completed transaction is the version made available in connection with that transaction, subject to applicable law.
